On private projects, Mr. Marx can ensure his clients’ lien rights are effectively
exercised to ensure maximum recovery. On public projects, contractors
do not have the ability to file a lien because liens do not attach to publicly owned realty.
When contractors are not paid on public projects, they have a “lien” or claim against the
Payment bond pursuant to Alaska’s Little Miller Act (AS 36.25 et seq)
Mr. Marx has succsessfully handled a number of Little Miller Act claims in state court
usually on behalf of Subcontractors who have not been paid by the
Prime on a public works project. These claims often require filing
suit against the payment bond under the Act, and seeking default interest and attorney fees under the subcontract.
