CONSTRUCTION LAW

Mr. Marx has successfully handled a number of disputes on behalf of General Contractors and Subcontractors on both public and private projects, both payment and performance related..

Click Contractor Statutes for a PDF of the applicable state statutes and regulations for contractors in Alaska.

On private projects, Mr. Marx can ensure his clients’ lien rights are effectively exercised to ensure maximum recovery. On public projects, contractors do not have the ability to file a lien because liens do not attach to publicly owned realty. When contractors are not paid on public projects, they have a “lien” or claim against the Payment bond pursuant to Alaska’s Little Miller Act (AS 36.25 et seq)

Mr. Marx has succsessfully handled a number of Little Miller Act claims in state court usually on behalf of Subcontractors who have not been paid by the Prime on a public works project. These claims often require filing suit against the payment bond under the Act, and seeking default interest and attorney fees under the subcontract.

Mr. Marx also provides contract drafting services for construction companies of all sizes and relies on ConsensusDocs ™ to ensure his clients have a fair, simple, and effective road map for their construction projects from start to finish.
